Your use of the web site at www.tastysnack.asia, the mobile applications and other affiliated websites of Tasty Snack (collectively referred to as the “Site”), and the sale of goods and any other related services offered by Tasty Snack on the Site (collectively referred to as the “Services”), is subject to the following Terms and Conditions of Use (“Terms of Use”).

THESE TERMS OF USE ARE A LEGAL AGREEMENT BETWEEN YOU AND TASTY SNACK. PLEASE READ THE TERMS OF USE CAREFULLY.

By using the Site, you agree to be bound by these Terms of Use without qualification. These Terms of Use shall apply to your use of the Site and the Services provided on and through it, and your purchase(s) of the products sold on the Site (“Products”).

Tasty Snack reserves the right, at its sole discretion, to modify, add and/or remove any portion(s) of these Terms of Use at any time without giving prior notice. By continuing to use the Site, you agree to and accept the amendments to the Terms of Use which are published on the date of your use of the Site.

You must be at least 18 years old in order to use the Site. If you are under 18 years old, please obtain consent from a parent or legal guardian to use the Site and make purchases on it. By your continued use of the Site, it shall be deemed that you have obtained such consent.

When using the Site, you may not engage in the following prohibited conduct:

• Copy, trace, monitor, acquire, distribute or commercially exploit, without permission from Tasty Snack, any part of the Site (including the source codes, information, documents, features and digital activities of and on the Site) by any means, except to do the same in relation to the information of or in your own user account.
• Affect or undermine the navigational structure or presentation of the Site.
• Gain unauthorised access to or interfere with the proper functioning of any part of the Site or any system(s) or network(s) connected to the Site or Tasty Snack’s server. Such unauthorised access or interference include (i) probing or testing the vulnerability of the security and authentication measures and the integrity of the infrastructure on and of the Site or any system(s) or network(s) connected to the Site or Tasty Snack’s server; (ii) hacking the Site or any of the Services to obtain information on other users of the Site; and (iii) use or upload any software or material that contains viruses, malicious codes or components on the Site.
• Pretend that you are, or that you represent, any other individual or entity.
• Use the Site for any purpose that is unlawful or to procure the carrying out of any illegal activity or other activity that would infringe the rights of Tasty Snack or others.
• Post content that is unlawful, obscene, defamatory, threatening, harassing, seditious, hateful or embarrassing to any other person or entity.
• Post content of third party personal data in violation of the Personal Data Protection Act 2012 or other applicable personal data protection laws.

User Accounts

You may register and create a user account when using and making purchases on the Site. While Tasty Snack will use best efforts to keep the Site environment safe and secure, you are responsible for: (i) providing correct details when registering your user account on the Site; (ii) keep your username and password confidential and secure; (iii) preventing unauthorised access to or fraudulent use of your user account; and (iv) changing your password from time to time.

All purchases made through your user account shall be your responsibility and Tasty Snack has the sole discretion to: (i) cancel any product order placed through your user account; (ii) restrict access from your user account; or (iii) delete your user account and any comments posted by you or through your user account; and (iv) prohibit any person’s future use of the Site.

Please notify Tasty Snack immediately when you notice or discover any unauthorised use of your user account.

Product Descriptions, Prices and Availability

All communications made and information provided by Tasty Snack on or through the Site in respect of the products sold on the Site (each a “Product”) are invitations to treat only. Prices and availability of the Products are subject to change at any time without reason or prior notice.

All listed prices are in Singapore Dollars (SGD) and exclusive of prevailing taxes, duties and delivery and additional packaging charges unless otherwise stated. Taxes and duties will be calculated and notified to you at the ‘Check Out’ page of the Site and charged when you place your product order.

Placing Orders on the Site

All orders for the Products (each a “product order”) must be placed via the Site or one of the social media accounts of Tasty Snack. Tasty Snack will not accept any product order placed in a different manner. If you are placing your product order via one of our social media accounts, these Terms of Use will be notified or referred to you. By proceeding to confirm your product order after receiving such notification or reference, you will be deemed to have agreed to these Terms of Use.

You are solely responsible for the accuracy of your product order(s). All product orders are unconditional, final and irrevocable except where you are cancelling your product order(s) in the circumstances stated in clause 3 (Return and Cancellation Policy).

Each product order is an offer of contract from you which is not legally binding until accepted by Tasty Snack. Tasty Snack reserves the right to decline to accept your product offer(s) for any reason. In the event that your product offer(s) is accepted, Tasty Snack will communicate the acceptance to you in and only in the form of a confirmation e-mail sent to your e-mail address which you provided to Tasty Snack.

Once Tasty Snack accepts your product order (and provided that you made full payment), it shall process your order without your further consent and without any further reference or notice to you. The processing time for each product order may vary. Tasty Snack shall be entitled to process every product order within a reasonable amount of time provided that Tasty Snack shall inform you about any substantial delay (whether caused by Tasty Snack or otherwise) in meeting your product order(s).

Payment for Your Orders

You may pay for your product order(s) using any of the payment methods available on the Site. Tasty Snack will not accept payment made by any other method or in a manner that is not specified on the Site on in These Terms of Use. Payment methods available on the Site may be added, removed or subject to additional terms and conditions from time to time.

Payment for your product order(s) must be made in full by the method you have selected at the time you placed your product order(s). Tasty Snack will not process your product order until it receives full payment. Tasty Snack will charge for your product order(s) only upon its acceptance of your product order(s) unless your product order is cancelled in accordance with clause 3 (Return and Cancellation Policy) prior to Tasty Snack communicating its acceptance. All payments made are non-refundable and irrevocable.

You are responsible for your choice of payment method and may be subject to the agreement(s) applicable to the chosen payment method (you shall separately pay any additional charges imposed by the banks in connection with your payment for your product order(s)). Tasty Snack shall not be liable for any failure, restriction or disruption in your making of payment to Tasty Snack which did not result from any fault or error of Tasty Snack. Neither Tasty Snack nor the third parties that process your payment according to your chosen payment method shall not in any circumstances be deemed as the agent of each other. If you have any queries in relation to the payment processing charges imposed by a third-party bank, please contact the relevant bank directly.

Your payment made according to the method of your choice and in the manner specified on the Site shall not be taken to discharge you from your above responsibility. Neither shall the specifying of the payment methods on the Site be taken or deemed as Tasty Snack voluntarily assuming the risk and liability for any loss of your payment.

Delivery of Your Orders

Tasty Snack does not deliver the Products to you itself. All product orders will be sent to you via third party carriers. The Products will be delivered according to your choice of delivery method as stated in your product order, and to the address which you have specified in your product order. Tasty Snack shall not be responsible for any delay or error in delivery due to your choice of delivery method or wrongly specifying the delivery address, or any loss or damage of your Products once the Products are sent to the third party carrier.

The delivery of your product order shall be subject to the availability of the Products. Tasty Snack reserves the right to change out any products depending on availability. If there will be a substantial delay in Tasty Snack fulfilling your product order because of the unavailability of the Products, Tasty Snack will use reasonable efforts to inform you about the delay and ship your product order as soon as it is able to do so. Upon receiving such notification on the substantial delay, you may choose to:

1. cancel your product order within two (2) days and request for a refund according to the procedure set out in clause 3 (Return and Cancellation Policy); or
2. substitute the unavailable Products with other Products of the same or greater value, provided that you shall pay for the difference between the value of your original product order and your substituted product order, if any.

The delivery time as stated on the Site is an estimate only and shall not be taken as a warranty or indemnity as to the amount of time it takes to deliver your product order. Whilst Tasty Snack endeavours to make every reasonable effort to deliver the Products to you, Tasty Snack cannot and shall not be liable for any delay in delivery not caused by its failure to process your product order (up until the Products are shipped) within a reasonable amount of time.

Unless you have already cancelled your product order in accordance with this clause 2 or clause 3 (Return and Cancellation Policy), if you fail or refuse to take delivery of your product order, Tasty Snack will use reasonable efforts to contact you regarding the failed delivery and may arrange for a second delivery within a reasonable amount of time. Tasty Snack is entitled to not attempt a second delivery unless you confirm that you will receive or collect the second delivery. Any deterioration in the quality of the Products arising, partly or wholly, from your failure to take delivery of the Products on its first delivery shall not be responsibility Tasty Snack. In any event, regardless of whether a second delivery was attempted or made, Tasty Snack is entitled to retain the payment for such product order.

If additional Products were delivered to you by mistake, Tasty Snack reserves the right to charge you for these additional Products unless you initiated a Return Request to return them in accordance with clause 3 (Return and Cancellation Policy) within two (2) days from the date of their delivery.

Discount Codes and Promotional Vouchers

You may redeem or use discount codes or promotional vouchers from Tasty Snack when making your purchase on the Site. Such discount codes or promotional vouchers must be redeemed or used at the ‘Check Out’ page of the Site only; redemption or use of discount codes or promotional vouchers before or after you have made your purchase will not be accepted by Tasty Snack.

Notwithstanding this clause 2(e), specific terms and conditions associated with each discount code or promotional voucher may be stipulated on or attached to the discount code or promotional voucher.

You must not re-sell, distribute, make copies of or otherwise commercially exploit the Products (including without limitation their packaging and the prints and labels on the packaging) you purchased using discount codes or promotional vouchers from Tasty Snack.

In cases of fraud or suspicion of misuse or illegal use of our discount codes or promotional vouchers, Tasty Snack is entitled to reject any of such redemption or use of discount code or promotional voucher and/or require a different means of payment for the full value of any product order.

Tasty Snack assumes no liability for the failure to provide or loss or theft of discount codes or promotional vouchers.

Tasty Snack may at its sole discretion discontinue or cancel any discount codes or promotional vouchers previously issued and shall not be liable for any losses arising therefrom.

Return of your Products

Products which are sold at a discounted price or given by Tasty Snack free of charge are neither returnable nor refundable.

Please check your product order upon delivery. Subject always to Tasty Snack not being liable for Products that are damaged or lost during transit under clause 2(d) above or due to the circumstances set out in the Product Warranty in clause 4 below, in the event that the Product at the time of receipt is (i) the wrong Product; (ii) of a fundamentally different nature from such Product sold on the Site; (iii) expired, visibly spoiled or unconsumable; (iv) contained in broken packaging; or (v) appears to have been tampered with or unsafe for consumption, or at the time of you consuming the Products before their expiry, that they are spoiled or unconsumable, you may return the Product to Tasty Snack for a refund or replacement under clause 3(b).

Procedure for Return of Products

If you wish to return your Products for the reasons specified in this clause 3, please write to us at askus@tastysnack.asia to initiate a Return Request within two (2) days from the date of the delivery of your product order. Upon receiving your Return Request, Tasty Snack may require additional information and/or documentation about the state of your Products before accepting your Return Request and processing your refund. Tasty Snack shall, at its absolute discretion, refund to you the whole or part of the purchase price of the returned Products.

Upon receiving confirmation of Tasty Snack’s acceptance of your Return Request, please send your Products to be returned to 1 Kim Seng Road #13-04, Great World City Singapore 237994. Tasty Snack recommends that you use a carrier which offers delivery tracking service to send your returned Products. Tasty Snack shall not be responsible for any loss of the Products before it is delivered and received by Tasty Snack.

Cancellation of your Order

If the price of a Product was misstated on the Site when you placed an order for it, and you have not received the delivery of the Product yet, Tasty Snack reserves the right to cancel your product order and terminate the sale and purchase agreement between you and Tasty Snack without your consent. Any payment that has already been made by you for such Product shall then be refunded.

Subscription Plans

Should you change your mind about your subscription plan, you may at any time change or modify how often you wish to receive your subscription boxes, or cancel your subscription plan or any subscription box which has not been delivered to you free of charge. To initiate a Modification or Cancellation Request, please write to us at askus@tastysnack.asia at least seven (7) days before the next date for the delivery of your Products.

Product orders which have been delivered to you under your subscription plan cannot be cancelled; please initiate a Return Request in accordance with clause 3(b) above instead.

Depending on the payment method that you have chosen for your subscription plan, if the cancelled order(s) have not been paid for, Tasty Snack will cancel the relevant transactions of the pending payments; if the cancelled orders have already been paid by you, Tasty Snacks will refund the relevant payments to you in accordance with clause 3(e) below subject to the terms and conditions therein.

Refunds

Your refund will be made to you via the same method which you have chosen and used to make the original payment to Tasty Snack. The costs associated with the refund (such as the processing fees charged by the payment processor) shall be borne by Tasty Snack.

Tasty Snack does not promise the timeliness of your refund; the amount of time Tasty Snack may take to process your refund, if it is indicated on the Site or in any communication to you, is only an estimate and Tasty Snack shall not be liable for any delay in the refund unless the delay is unreasonable and is due to the fault or error of Tasty Snack.

All refunds are conditional on Tasty Snack’s acceptance of your valid Return Request and receipt of your returned Products. Tasty Snack reserves the right and absolute discretion to inspect any returned Product and refuse receipt of a returned Product which (i) if the Product is returned for being the wrong Product sent to you, is used or not in its original packaging; (ii) does not correspond to your product order and (iii) has expired due to your delay in returning the Products to Tasty Snack.

In the event of Tasty Snack refusing receipt of your returned Products, Tasty Snack shall not process your refund and may send the returned Products back to you at your own costs.

Except as expressly provided in this Product Warranty, Tasty Snack excludes (to the fullest extent permitted by the applicable laws) all other warranties (express and implied) in respect of the Products.

Tasty Snack shall have the right to pass title in the Products to you at the time of the delivery and upon full payment by you and none of the Products at such time of delivery and payment are the subjection of any option, right to acquire, assignment, mortgage, charge, lien or hypothecation or other encumbrance whatsoever (excepting only liens arising by operation of law in the normal course of trading).

While Tasty Snack makes every reasonable effort to provide an accurate description of the Products, we do not warrant that such description is always and completely accurate, up to date and free from error. Neither does Tasty Snack warrant that the Products shall from the date of delivery have a minimum period of shelf life left before the Product’s expiry (notwithstanding anything stated in their description) or that they will be suitable for any specific/ particular purpose (for example, dietary suitability or consumption without causing any allergy or dietary reaction) or use under any conditions even where you have communicated such specific/ particular purpose to us.

Tasty Snack shall not be liable for loss or damage (i) for any defect caused by or arising from unsuitable, negligent or improper use/ storage of the Products, wilful damage or the expiry of the Products; (ii) in respect of any defect in the Products arising after the expiry of the Products; or (iii) if the total purchase price for the Products has not been paid in cleared funds by the due date for payment.

Tasty Snack shall not be liable for any indirect, incidental, special or consequential damages, including without limitation damages for lost business or profits, suffered by you regardless of the nature of the claim (including negligence), even if foreseeable or you have been advised of the possibility of such damages. In any circumstances and to the fullest extent permitted by the applicable laws, Tasty Snack’s aggregate liability for the under these Terms of Use, regardless of the nature of your claim (including negligence), shall not exceed the aggregate amount paid by you for your product order.

To the fullest extent permitted by law, Tasty Snack shall not be liable for any damage arising out of or in connection with the Site’s failure to function properly, whether such damage is caused by failure of performance, system error, system defect, delay in operation, computer virus or theft in relation to the Site.

“Intellectual Property Rights” include copyright and neighbouring and related rights, moral rights, design rights, registered designs, database rights, patents, business names, trademarks, trade names, domain names, rights in get-up, know-how, trade secrets and rights in confidential information (including the rights to use and protect confidential information), rights to goodwill and right to sue for passing off or unfair competition (in each case whether or not registered) and including all applications for any of them anywhere in the world and rights to apply for and be granted, renewals or extensions of, and rights to claim priority from, such rights and all similar or equivalent rights or forms of protection which subsists or may subsist now or in the future in any part of the world.

The Intellectual Property Rights subsisting in and on the Site and the materials thereon are owned, licensed to or controlled by Tasty Snack and/or our licensors, service providers or suppliers. No such Intellectual Property Rights or any part of the Site or the materials thereon may be reproduced, modified, transmitted, presented, distributed or republished by you without Tasty Snack’s express prior written consent or that of the relevant copyright owners.

By submitting your personal data to Tasty Snack, you consent to allow Tasty Snack and its service providers to process, transmit and/or store your personal data for the purposes of processing and delivering your product order(s). Tasty Snack will only process and/or transmit your personal data in a manner that is reasonably necessary for providing the Services to you. In relation to the personal data provided by you to Tasty Snack, you shall be responsible as sole data controller for complying with all applicable data protection or similar laws that regulate the processing of personal data.

These Terms of Use shall be governed by and construed in all aspects in accordance with the laws of Singapore. You agree to irrevocably submit to the exclusive jurisdiction of the Courts of Singapore to settle any dispute or claim arising out of or in connection with these Terms of Use.

In no circumstances shall Tasty Snack be liable for any failure or delay in the performance of its obligations under these Terms of Use arising out of, directly or indirectly, causes or forces beyond its reasonable control, including without limitation strikes, industrial disputes (whether involving the workforce of the Tasty Snack or any other party), failure of a utility service or transport or telecommunications network, accidents, acts of war or terrorism, civil or military disturbances, nuclear or natural catastrophes or acts of God, malicious damage, compliance with any law or governmental order, rule, regulation or direction and interruptions.

Whilst Tasty Snack endeavours to make every reasonable effort to deliver the Products to you, Tasty Snack cannot and shall not be liable for any delay in delivery not caused by its failure to process your product order (up until the Products are shipped) within a reasonable amount of time.

Unless you have already cancelled your product order in accordance with this clause 2 or clause 3 (Return and Cancellation Policy), if you fail or refuse to take delivery of your product order, Tasty Snack will use reasonable efforts to contact you regarding the failed delivery and may arrange for a second delivery within a reasonable amount of time. Tasty Snack is entitled to not attempt a second delivery unless you confirm that you will receive or collect the second delivery. Any deterioration in the quality of the Products arising, partly or wholly, from your failure to take delivery of the Products on its first delivery shall not be responsibility Tasty Snack. In any event, regardless of whether a second delivery was attempted or made, Tasty Snack is entitled to retain the payment for such product order.

If additional Products were delivered to you by mistake, Tasty Snack reserves the right to charge you for these additional Products unless you initiated a Return Request to return them in accordance with clause 3 (Return and Cancellation Policy) within two (2) days from the date of their delivery.

Discount Codes and Promotional Vouchers

You may redeem or use discount codes or promotional vouchers from Tasty Snack when making your purchase on the Site. Such discount codes or promotional vouchers must be redeemed or used at the ‘Check Out’ page of the Site only; redemption or use of discount codes or promotional vouchers before or after you have made your purchase will not be accepted by Tasty Snack.

Notwithstanding this clause 2(e), specific terms and conditions associated with each discount code or promotional voucher may be stipulated on or attached to the discount code or promotional voucher.

You must not re-sell, distribute, make copies of or otherwise commercially exploit the Products (including without limitation their packaging and the prints and labels on the packaging) you purchased using discount codes or promotional vouchers from Tasty Snack.

In cases of fraud or suspicion of misuse or illegal use of our discount codes or promotional vouchers, Tasty Snack is entitled to reject any of such redemption or use of discount code or promotional voucher and/or require a different means of payment for the full value of any product order.

Tasty Snack assumes no liability for the failure to provide or loss or theft of discount codes or promotional vouchers.

Tasty Snack may at its sole discretion discontinue or cancel any discount codes or promotional vouchers previously issued and shall not be liable for any losses arising therefrom.

Return of your Products

Products which are sold at a discounted price or given by Tasty Snack free of charge are neither returnable nor refundable.

Please check your product order upon delivery. Subject always to Tasty Snack not being liable for Products that are damaged or lost during transit under clause 2(d) above or due to the circumstances set out in the Product Warranty in clause 4 below, in the event that the Product at the time of receipt is (i) the wrong Product; (ii) of a fundamentally different nature from such Product sold on the Site; (iii) expired, visibly spoiled or unconsumable; (iv) contained in broken packaging; or (v) appears to have been tampered with or unsafe for consumption, or at the time of you consuming the Products before their expiry, that they are spoiled or unconsumable, you may return the Product to Tasty Snack for a refund or replacement under clause 3(b).

Procedure for Return of Products

If you wish to return your Products for the reasons specified in this clause 3, please write to us at askus@tastysnack.asia to initiate a Return Request within two (2) days from the date of the delivery of your product order. Upon receiving your Return Request, Tasty Snack may require additional information and/or documentation about the state of your Products before accepting your Return Request and processing your refund. Tasty Snack shall, at its absolute discretion, refund to you the whole or part of the purchase price of the returned Products.

Upon receiving confirmation of Tasty Snack’s acceptance of your Return Request, please send your Products to be returned to 1 Kim Seng Road #13-04, Great World City Singapore 237994. Tasty Snack recommends that you use a carrier which offers delivery tracking service to send your returned Products. Tasty Snack shall not be responsible for any loss of the Products before it is delivered and received by Tasty Snack.

Cancellation of your Order

If the price of a Product was misstated on the Site when you placed an order for it, and you have not received the delivery of the Product yet, Tasty Snack reserves the right to cancel your product order and terminate the sale and purchase agreement between you and Tasty Snack without your consent. Any payment that has already been made by you for such Product shall then be refunded.

Subscription Plans

Should you change your mind about your subscription plan, you may at any time change or modify how often you wish to receive your subscription boxes, or cancel your subscription plan or any subscription box which has not been delivered to you free of charge. To initiate a Modification or Cancellation Request, please write to us at askus@tastysnack.asia at least seven (7) days before the next date for the delivery of your Products.

Product orders which have been delivered to you under your subscription plan cannot be cancelled; please initiate a Return Request in accordance with clause 3(b) above instead.

Depending on the payment method that you have chosen for your subscription plan, if the cancelled order(s) have not been paid for, Tasty Snack will cancel the relevant transactions of the pending payments; if the cancelled orders have already been paid by you, Tasty Snacks will refund the relevant payments to you in accordance with clause 3(e) below subject to the terms and conditions therein.

Refunds

Your refund will be made to you via the same method which you have chosen and used to make the original payment to Tasty Snack. The costs associated with the refund (such as the processing fees charged by the payment processor) shall be borne by Tasty Snack.

Tasty Snack does not promise the timeliness of your refund; the amount of time Tasty Snack may take to process your refund, if it is indicated on the Site or in any communication to you, is only an estimate and Tasty Snack shall not be liable for any delay in the refund unless the delay is unreasonable and is due to the fault or error of Tasty Snack.

All refunds are conditional on Tasty Snack’s acceptance of your valid Return Request and receipt of your returned Products. Tasty Snack reserves the right and absolute discretion to inspect any returned Product and refuse receipt of a returned Product which (i) if the Product is returned for being the wrong Product sent to you, is used or not in its original packaging; (ii) does not correspond to your product order and (iii) has expired due to your delay in returning the Products to Tasty Snack.

In the event of Tasty Snack refusing receipt of your returned Products, Tasty Snack shall not process your refund and may send the returned Products back to you at your own costs.

Except as expressly provided in this Product Warranty, Tasty Snack excludes (to the fullest extent permitted by the applicable laws) all other warranties (express and implied) in respect of the Products.

Tasty Snack shall have the right to pass title in the Products to you at the time of the delivery and upon full payment by you and none of the Products at such time of delivery and payment are the subjection of any option, right to acquire, assignment, mortgage, charge, lien or hypothecation or other encumbrance whatsoever (excepting only liens arising by operation of law in the normal course of trading).

While Tasty Snack makes every reasonable effort to provide an accurate description of the Products, we do not warrant that such description is always and completely accurate, up to date and free from error. Neither does Tasty Snack warrant that the Products shall from the date of delivery have a minimum period of shelf life left before the Product’s expiry (notwithstanding anything stated in their description) or that they will be suitable for any specific/ particular purpose (for example, dietary suitability or consumption without causing any allergy or dietary reaction) or use under any conditions even where you have communicated such specific/ particular purpose to us.

Tasty Snack shall not be liable for loss or damage (i) for any defect caused by or arising from unsuitable, negligent or improper use/ storage of the Products, wilful damage or the expiry of the Products; (ii) in respect of any defect in the Products arising after the expiry of the Products; or (iii) if the total purchase price for the Products has not been paid in cleared funds by the due date for payment.

Tasty Snack shall not be liable for any indirect, incidental, special or consequential damages, including without limitation damages for lost business or profits, suffered by you regardless of the nature of the claim (including negligence), even if foreseeable or you have been advised of the possibility of such damages. In any circumstances and to the fullest extent permitted by the applicable laws, Tasty Snack’s aggregate liability for the under these Terms of Use, regardless of the nature of your claim (including negligence), shall not exceed the aggregate amount paid by you for your product order.

To the fullest extent permitted by law, Tasty Snack shall not be liable for any damage arising out of or in connection with the Site’s failure to function properly, whether such damage is caused by failure of performance, system error, system defect, delay in operation, computer virus or theft in relation to the Site.

“Intellectual Property Rights” include copyright and neighbouring and related rights, moral rights, design rights, registered designs, database rights, patents, business names, trademarks, trade names, domain names, rights in get-up, know-how, trade secrets and rights in confidential information (including the rights to use and protect confidential information), rights to goodwill and right to sue for passing off or unfair competition (in each case whether or not registered) and including all applications for any of them anywhere in the world and rights to apply for and be granted, renewals or extensions of, and rights to claim priority from, such rights and all similar or equivalent rights or forms of protection which subsists or may subsist now or in the future in any part of the world.

The Intellectual Property Rights subsisting in and on the Site and the materials thereon are owned, licensed to or controlled by Tasty Snack and/or our licensors, service providers or suppliers. No such Intellectual Property Rights or any part of the Site or the materials thereon may be reproduced, modified, transmitted, presented, distributed or republished by you without Tasty Snack’s express prior written consent or that of the relevant copyright owners.

By submitting your personal data to Tasty Snack, you consent to allow Tasty Snack and its service providers to process, transmit and/or store your personal data for the purposes of processing and delivering your product order(s). Tasty Snack will only process and/or transmit your personal data in a manner that is reasonably necessary for providing the Services to you. In relation to the personal data provided by you to Tasty Snack, you shall be responsible as sole data controller for complying with all applicable data protection or similar laws that regulate the processing of personal data.

These Terms of Use shall be governed by and construed in all aspects in accordance with the laws of Singapore. You agree to irrevocably submit to the exclusive jurisdiction of the Courts of Singapore to settle any dispute or claim arising out of or in connection with these Terms of Use.

In no circumstances shall Tasty Snack be liable for any failure or delay in the performance of its obligations under these Terms of Use arising out of, directly or indirectly, causes or forces beyond its reasonable control, including without limitation strikes, industrial disputes (whether involving the workforce of the Tasty Snack or any other party), failure of a utility service or transport or telecommunications network, accidents, acts of war or terrorism, civil or military disturbances, nuclear or natural catastrophes or acts of God, malicious damage, compliance with any law or governmental order, rule, regulation or direction and interruptions.
